Update on Borrowers with DACA Status on FHA & VA Commission Loan Programs

Dear Lending and Real Estate Partners,

Great News!!

On January 20, 2021, FHA provided updated eligibility guidance for individuals under DACA (Deferred Action for Childhood Arrivals) status.

The Commission is pleased to announce it will accept DACA status borrowers on the Home Advantage and House Key Opportunity FHA & VA products, effective with applications dated on and after January 19, 2021.

The Residency and Eligibilty Guide and Section 3 of the Home Advantage and House Key Opportunity manuals have been updated to reflect the above and provide further details.

The lender is responsible for documenting the lender delivery package sent to the appropriate loan servicer, per investor guidelines.

DACA status borrowers for Freddie Mac HFA Advantage and USDA loans are not eligible.
