HUD Mortgagee Letter 19-06: Our Affirmation

It is business as usual at the Washington State Housing Finance Commission!

As required by HUD’s Mortgagee Letter 19-06 dated April 18, 2019, which concerns downpayment assistance and operating in a governmental capacity, the Washington State Housing Finance Commission confirms that we operate our downpayment assistance program in a manner consistent with HUD guidelines as stated in 4000.1 of the Single Family Housing Policy Handbook.

1. Here is a link to the Commission’s authorizing legislation, RCW 43.180, which documents the Commission’s authority as a governmental entity to operate downpayment assistance programs within Washington state.

2. Here is the link to the required opinion from the Commission’s legal counsel (signed and dated within two years of closing the transaction) stating that they reviewed our downpayment assistance programs and concluded our programs are consistent with the Mortgagee Letter 19-06.

3. The Commission’s Commitment Letter for FHA loans has now been updated in Emphasys with the language required by the Mortgagee Letter. As usual, this letter can be downloaded electronically from Emphasys by the Contact Name who reserved the funds in the Emphasys system, after the loan is “Committed.” See a sample commitment letter here.

Section 13 of the Home Advantage and House Key manuals have been updated.

Please note all terms and conditions of the Mortgage Origination Agreement remain in full effect.
